The ``Obsidian Artistic License''

Preamble

This document is derived from text originally contained in a version of the PERL Artistic License, and is especially designed for the OBSIDIAN virtual-world system. The original model used for this document was The Perl Artistic License.

Statement Of Intent (Definitions given below):

Definitions

``Package'' refers to the collection of files distributed by the Copyright Holder, and derivatives of that collection of files created through textual modification.

``Standard Version'' refers to such a Package if it has not been modified from a Package published by the Copyright Holder, or has been modified in accordance with the wishes of the Copyright Holder as specified below.

``Copyright Holder'' is whoever is named in the copyright or copyrights for the package, or trustees named by such persons in a legally binding form as being responsible for administration of copyright matters regarding the package.

``You'' is you, if you're thinking about copying or distributing this Package for free or for profit.

``Reasonable copying fee'' is whatever you can justify on the basis of media cost, duplication charges, time of people involved, and so on.

``Freely Available'' means that no fee is charged for the item itself, though there may be fees involved in handling the item. It also means that recipients of the item may redistribute it under the same conditions they received it.

``Freely Accessible'' means that no fee is charged for access to the item itself.

``Bundle'' means a collection of machine-readable information, textual or binary, containing any version of the Package (Standard or otherwise), regardless of any other material present along with the Package.

1. You may make and give away verbatim copies of the source form of the Standard Version of this Package without restriction, provided that you duplicate all of the original copyright notices and associated disclaimers. You may only charge at maximum a reasonable copying fee for this action.

2. You may apply bug fixes, portability fixes and other modifications derived from the Public Domain and having the blessing of the Copyright Holder, or from the Copyright Holder. A Package modified in such a way shall still be considered the Standard Version.

3. You may otherwise modify your copy of this Package in any way, provided that you insert a prominent notice in each changed file stating how and when you changed that file, and provided that you do at least ONE of the following:

5. You may charge a reasonable copying fee for any distribution of this Package. You may charge any fee you choose for support of this Package. You may not charge a fee for this Package itself except by prior arrangement with the Copyright Holder or else as described elsewhere in this document.

6. C subroutines (or comparably compiled subroutines in other languages) supplied by you and linked into this Package shall not be considered part of this Package, provided they employ no code from the Package within themselves.

7. You may charge any fee above and beyond the reasonable copying fee for distribution of any Bundle containing any part of any version of the Package (Standard or otherwise) provided that you complete arrangements with the Copyright Holder prior to sale for 5% of gross profits from sale of each Bundle to be given unconditionally to the Copyright Holder.

8. You may run any version of the Package or any software derived from the Package as a freely accessible server (that is, you are not charging any fee for interaction with the server software).

9. You may charge any fee for access to a server comprised of or containing any version of the Package or derivative of the Package provided that you complete arrangments with the Copyright Holder, prior to charging, for 5% of gross profits from any such charging to be given unconditionally to the Copyright Holder.

10. The name of the Copyright Holder may not be used to endorse or promote products or products derived from this software without specific prior written permission from the Copyright Holder.

11. THIS PACKAGE IS PROVIDED ``AS IS'' AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE COPYRIGHT HOLDERS SHALL NOT BE LIABLE FOR ANY DAMAGE OR LOSS OF ANY KIND WHATSOEVER INCURRED IN ANY WAY WHATSOEVER BY THE USE OR FAILURE OF USE OF THIS PACKAGE OR ITS DERIVATIVES.
